I agree to assume all responsibility for any and all risk of damage or injury that may occur to me as a participant in Tufts University’s Seventh Annual President’s Marathon Challenge. In consideration of applying for and being accepted for this event, I hereby, for myself, my heirs, executors and administrators, release and discharge Tufts University, their employees, volunteers and consultants, the Boston Athletic Association and any and all sponsors of the Boston Marathon, and the President’s Marathon Challenge from all claims, damages, rights of action, present or future, whether the same be known, anticipated or unanticipated, resulting from or arising out of, or in incident to, my preparation for and participation in this event. I further agree to adhere to all stipulations of the Boston Athletic Association’s Entry Form and Runner’s Agreement, Waiver, Release and Acknowledgement as required for official entry in the Boston Marathon on April 20, 2009. I certify that I am aware of the physical demands and hazards of training for and participating in a marathon, and that I am physically fit and will train sufficiently for participation in this event. I also grant permission for the use of my name and/or picture in any broadcast, photography or other account of this event. I have read, and understand and assent to the foregoing liability waiver.

I understand that if I am assigned one of Tufts University’s Invitational BAA entries, my fundraising commitment exists regardless of my ability to train for and run the Boston Marathon on 4/20/09, unless my written cancellation is received by the President’s Marathon Challenge by February 1, 2009.

In consideration of being accepted as a participant in the 7th Annual Tufts President’s Marathon Challenge 2009, I agree to collect a minimum of:

$2,500 - Alumni, Parent, Faculty, Staff, Friend.

$1,000 – Current Tufts University Student.

for the Marathon Challenge for the benefit of nutrition, medical, and fitness research, education, and outreach at Tufts University.

I have read, and understand and assent to the foregoing fundraising agreement.
